1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and canadianyardie Media Group Inc. ("canadianyardie", "we", "us", or "our"), regarding your access to and use of our digital platforms, including canadianyardie.com, our 24/7 YardVybz Radio stream, RSS feeds, email newsletters, and multimedia broadcast portals. If you do not agree to these Terms, you must immediately cease all access and use of the platform.

2. Intellectual Property & Editorial Content

All original articles, editorial commentary, investigative features, graphics, audio productions, code, logos, and visual presentation on canadianyardie are the intellectual property of canadianyardie Media Group Inc. or licensed to us by third-party contributors:

• Personal & Non-Commercial Use: You are granted a limited, revocable, non-exclusive license to view and read our content for personal, non-commercial purposes.
• Fair Quotation & Attribution: News organizations, bloggers, and academics may quote brief excerpts (up to 75 words) provided direct clickable attribution to canadianyardie.com and the original article permalink is visibly included.
• Prohibited Scraping: Automated scraping, wholesale content mirroring, or unauthorized reproduction of entire articles or databases without express prior written consent is strictly prohibited.

3. YardVybz Radio Streaming & Audio Broadcasting

canadianyardie provides access to live 24/7 streaming audio via YardVybz Radio:

• Personal Entertainment License: The audio stream is provided free of charge for real-time personal listening only.
• No Stream Ripping or Redistribution: You agree not to record, rip, rebroadcast, duplicate, or re-transmit the digital audio stream to public channels or commercial venues without specific authorization.
• Music Rights: Track rights, compositions, master recordings, and dubplate selections remain the property of their respective recording artists, producers, and publishers.

4. Real-Time Dancehall Charts & External Platforms

Our Top 10 Charts, Top 5 Countdown widgets, and Apple Music / Spotify breakdowns are curated for cultural indexing, entertainment, and statistical measurement. canadianyardie does not sell music downloads or act as a digital music retailer. Clicking on streaming platform links (Apple Music, Spotify, YouTube) redirects you to independent third-party platforms governed by their own terms of service and licensing.

5. User Comments, Submissions & News Tips

When submitting comments, news tips, community event notices, or restaurant review feedback:

• Community Standards: You must not post defamatory, abusive, threatening, racist, hateful, obscene, or infringing material.
• License Granted to canadianyardie: By submitting tips, photos, or comments, you grant canadianyardie a perpetual, royalty-free, worldwide license to publish, excerpt, edit, and feature such submissions in our news reporting and archives.
• Editorial Discretion: We reserve the right to moderate, remove, or refuse any user submission or comment at our sole discretion.

6. Music, Audio & Media Submissions (Artists, Producers & DJs)

canadianyardie accepts musical tracks, singles, riddim stems, albums, and DJ mixtapes submitted through our platform or dispatched directly to canadianyardie@gmail.com:

• 100MB Submission Limit: Direct file uploads are restricted to a maximum size of 100MB per submission in supported audio and archive formats (MP3, WAV, ZIP, M4A, FLAC, AAC, OGG, RAR). Projects exceeding 100MB must be provided via authorized streaming or cloud download links (SoundCloud, Spotify, Apple Music, Dropbox, Google Drive, Audiomack).
• Ownership & Copyright Retention: Artists, producers, songwriters, and DJs retain full underlying copyright and master recording ownership of their original works. canadianyardie does not claim ownership or publishing rights over your intellectual property.
• Promotional & Broadcast License: By submitting audio tracks, mixtapes, artwork, or press materials, you grant canadianyardie Media Group Inc. a non-exclusive, royalty-free, worldwide license to review, stream, broadcast on our 24/7 YardVybz Radio live station, feature in editorial reviews, include in digital countdowns/playlists, and quote in promotional diaspora coverage.
• Warranties & Rights Clearance: You represent and warrant that you are the creator, authorized distributor, or legal copyright holder of the submitted material, and that all third-party musical samples, featured vocalists, beats, and cover artwork are legally cleared and do not infringe upon any third party's rights.
• Editorial & Programming Discretion: Submission of music does not guarantee airplay, playlist addition, or editorial review. Programming decisions remain at the sole editorial discretion of our radio directors and music editors.
• Takedowns & Withdrawal: Rights holders may request the withdrawal of their submitted audio from broadcast consideration by emailing canadianyardie@gmail.com or our legal desk.

7. Advertising, Sponsors & Commercial Partnerships

canadianyardie operates advertising banners, sponsored stories, video sponsorships, and business directory profiles. Sponsored content is labeled in accordance with advertising transparency standards. canadianyardie does not endorse, guarantee, or assume liability for products, services, claims, or warranties offered by third-party advertisers.

8. Syndicated Third-Party News Feeds

Our LIVE BREAKING ticker and DIASPORA WIRE aggregate syndicated headlines and links from external news services (including CBC News, CP24, The Jamaica Gleaner, Jamaica Observer, The Jamaica Star, and DancehallMag). canadianyardie does not control external websites and is not liable for their content, availability, or accuracy.

9. Disclaimers & Limitation of Liability

canadianyardie is provided on an "AS IS" and "AS AVAILABLE" basis without representations or warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, canadianyardie Media Group Inc., its directors, editors, staff, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of, or inability to use, our platforms or content.

10. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Toronto, Ontario, Canada.
